What are the regulations associated with selling of non-FDA approved herbs incorporated into a food product?
I have developed an herbal formulation that I would like to incorporate into some kind of nutritional supplement or food product. I believe that the herbs are not FDA approved although they are sold as “not for human consumption”. Is there any legal way to incorporate these herbs into a product?
Basically the manufacturing plant making your product would be subject to the same regulations as general foods. However how you market the product could not have any claim to have any medical or health benefit with minor exceptions that lawyers would have to write.
There are nutritional manufacturers that you can find online that will make a new product for you according to what you want in it as long as it has no banned substances. Now these are general answers from my memory. More specific detail is needed for a complete answer.
